KARACHI: A divisional bench of High Court of Sindh (SHC) deferred till June 27, hearing of a constitutional petition filed by Independent Media Corporation (Jang Group) against Assistant Commissioner, Sindh Revenue Board (SRB) and other respondents.
The petitioner maintains that after passing of 18 th Amendment to the Constitution of Pakistan the power of collecting any tax has been transferred to Sindh government which introduced Sindh Sales Tax on Services Act 2011. They maintained that they are regularly paying the said tax on Advertisement on Television under heading 9802.1000 vide SNTN 51443013 on E-SRB portal and there was no default.
The petitioner maintains that SRB issued a show cause notice under section 23 (1-A) Read With Section 23 (2) of SSTS Act for recovery of rupees 1,229,073,990 for tax period July 2012 to June 2014 including penalty under section 43 and default surcharge under section 44.
The petitioner prays to the court to declare the show cause as illegal and that respondent Additional Commissioner has no power to issue a show cause.
