SHC calls comments in petitions by importers of tooth brushes

KARACHI: An Appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Muhammad Humayun Khan tagged three identical petitions with a leading petition while asking the counsel for Customs department to seek instructions and file para-wise comments.

The bench earlier heard Talal Tariq Khurshid of Franklin Law Associates appearing for petitioners MF Enterprises, Kiran Products and Gorey International. The young counsel drew the attention of the court to an order passed by it in Constitution Petition CP-D 4790 of 2016 filed by Ghulam ullah Sheikh Advocate of the same lawyers firm in which the court as an interim arrangement allowed release of the consignments on payment of differential amount between declared value and assessed value. The petitioner challenged the powers of the Director General, Valuation who while passing an Order in Original ordered enhancement of custom values in derogation of section 25 of the Customs Act 1969.

Masooda Siraj advocate appearing for the Customs Valuation informed the court that she would be representing the Valuation department. She sought time to seek instructions.

Talal Tariq Khurshid advocate requested for release of the consignments. The bench asked the counsel for Custom Valuation to seek instructions and file comments while tagging these petitions with the identical leading petition i.e 4790 of 2016.
