Tribunal rejects Pringles chips importer appeal against assessment order

KARACHI: Deciding an appeal against classification of chips as crisp savoury food products, Customs Appellate Tribunal rejected the appeal filed by M/s IBL Operations which imports Pringles Snacks (chips).

The importer challenged the classification made under HS Code/ PCT Heading 1905.9000 by the assessment authority claiming that previously the identical imported goods were assessed under HS Code 2004.1000 and thus benefit of Free Trade Agreement (FTA) between Pakistan and Malaysia was attracted.

Importer challenged the assessment order before the Collector (Appeals), Karachi under PCT Heading 1905.9000 as being erroneous.

The Director Customs Appeals held that as per documents including Commercial invoice, Certificate issued by the Ministry of International Trade, Malaysia shows that the goods were transacted under HS Code 2005-2002 and that importer changed the HS Code to 2004-1000 to avail FTA benefit. Collector Appeals rejected the petition.

The importer then approached the appellate tribunal, which considered the grievance of the importer in the light of descriptions provided under the three HS Codes /PCT heading viz 2004.1000, 2005.2000 and 1905.9000 .

After due deliberation, the tribunal agreed with the classification made by the Assistant Collector MCC Appraisement-West and while rejecting the appeal ordered that no reason was found to interfere with the assessment order.


Customs implements changes in WeBOC system

KARACHI: The Directorate of Reforms and Automation – Customs has inserted an additional text box in WeBOC software, which enables importers and customs agents to enter invoice value of the items imported along with the declared value.

The Directorate has implemented Change Request Form (CRF) 297 in the system with effect from September 02, 2015.

An official said that they had received requests from the importers and customs agents that the system allowed them to enter only one value and they were confused whether to enter Customs values as per the concerned Valuation Ruling or the invoice value. With the changes, this confusion would be eliminated and hence traders would be facilitated.

According to the changes in WeBOC software, an additional text box has been given to importer/custom agent to declare the invoice value for an item in addition to declared custom value.

It may be mentioned here that system shall not allow user to enter declared unit value of an item lower than the entered invoice value. The system shall calculate duties and taxes on the basis of declared unit value (self assessed).

Moreover, declared invoice value of an item shall be visible in GD print in the column of declared value so that importer may not face any problem if he submits the GD to any other organization like banks etc. However, assessed value shall also be visible on GD print.

Pakistan’s imports and exports witness shift in pattern

KARACHI: Data from an official report of Customs Appraisement South suggests that Pakistan’s import of leading items, which contributed significantly towards the Customs revenue declined drastically in the first two months of the current fiscal year.

Similarly, a considerable surge was witnessed in the import value of certain other goods and subsequent increase in duty collection on these imports.

Mineral fuels, mineral oils and products are imported in a very large quantity and contributes significantly in the revenue collection at Customs stage. The import of this commodity during the two months (July-August 2015) declined by 45 percent to Rs42.047 billion as against the import of Rs76.872 billion in the same period last year.

Similarly, import of electrical machinery and equipment in 2MFY16 stood at Rs26.461 billion as compared with the imports of Rs32.141 billion in the same period last year. Animal or vegetable fats/oils import also declined by 57 percent to Rs2.972 billion during the period under review as compared with the import of Rs7.405 billion in the same period last year.

Import of plastic and articles declined to Rs28.008 billion in 2MFY16 as against Rs31.864 billion in 2MFY15. Import value of iron and steel articles stood at Rs6.402 billion compared with the import value of Rs9.145 billion a year earlier.

Import of man-made filaments stood at Rs7.979 billion as against import of Rs10.171 billion in the same period last year. Import of man-made staple fibers stood at Rs13.29 billion as against import of Rs15.309 billion in the same period last year.

Import value of stranded wire, cables, plaited bands and the like of aluminum stood at Rs484.824 million and Customs duty collection of Rs90.499 million in 9MFY15 as compared with import value of Rs1.611 billion and custom duty of Rs290.502 million in 9MFY14.

Meanwhile, import of petroleum gases and hydrocarbons surged to Rs10.659 billion in 2MFY16 as compared to Rs14.002 million in the same period last year. Import of tea increased to Rs7.9 billion as against import of Rs4.98 billion in the same period last year.

Import of flat rolled products of other alloy steel (600mm and more) increased to Rs4.267 billion as against import of Rs1.509 billion in the same period last year.

Import of motor cars and vehicles increased in the July-August 2015 to Rs12.449 billion as against import of Rs9.834 billion in the same period last year.

Moreover, import of dish and bottle washing machines and machinery for filling surged to Rs1.112 billion in 2MFY16 compared with Rs305.028 million in the same period last year.

Transfer notification of PCS officers likely next week

KARACHI: The Federal Board of Revenue (FBR) is likely to notify transfers and postings of Pakistan Customs Service (PCS) officers of Grade-17 to Grade-19 next week, sources told Customnews.pk on Friday.

Sources maintained that transfers of four Grade-20 PCS officers might also be re-shuffled including one in Faisalabad and three in South region.

Member Customs is preparing the list of officers along with proposed postings, which would be forwarded to Chairman FBR for approval early next week.

Sources said that list of Grade-19 officers along with the proposed postings is almost complete, while the rest will be finalized by Monday.

It was also known that officers of Grade-16 would also be re-shuffled and the notifications in this regard are also expected next week.

Customs Appellate Tribunal remits fine, penalty on importer and agent

KARACHI: The Customs Appellate Tribunal allowed identical appeals filed by M/s Axis International and M/s MAK Enterprises clearing agent against the imposition of re-demption fine and penalty on alleged charge of mis-declaration in terms of loading capacity and value.

The appeals were preferred against a show cause notice issued by Additional Collector Adjudication Karachi. The show cause originated as it was reported to the Model Customs Collectorate, Appraisement that accused M/s Axis International imported a consignment from China declared to contain “LoadCell Type No Y2-C capacity 100 Kgs with accessories’. The clearance of consignment was sought clearing agent M/s MAK Enterprises who filed a declaration under HS 9031.8000 with a total declared value of  $900.

Upon examination of the consignment it was revealed that the appellants misdeclared the loading capacity which was found to be 30,000 Kgs instead of declared capcity 100 Kgs.

The department assessed the value for payment of duty to the tune of $30,000 as against the declared value of $900. Customs imposed a fine of rupees 1.092 for redemption of confiscated goods at the rate of 35 percent. The clearing agent was also fined Rs50,000.

The appellate tribunal during hearing ordered re-examination of the consignment. As a result of re-examination it was established that the appellant’s declaration was in accordance with the impugned goods and no violation was found.

The tribunal in view of re-examination report allowed the appeals ordering release of the confiscated goods with delay detention certificate. The fine imposed against clearing agent was also remitted by the tribunal.

FIR lodged against importer, agent and customs official for attempted evasion

KARACHI: The Directorate General of Intelligence & Investigation – Customs has lodged an FIR against an importer, clearing agent and customs examiner for attempting to evade duty/taxes to the tune of Rs1.6 million through multiple mis-declarations.

According to details of the case, information was received from Director Yaqoob Mako regarding huge evasion of duty and taxes through mis-declaration by M/s Anum Traders Hyderabad in the import of miscellaneous items.

The subject GD was cleared by MCC Port Qasim, however it was already blocked in the system at gate out stage.

The subsequent examination of the consignment was conducted in the supervision of Deputy Director Amjad Rajpar by SPS Ilyas, which found that it contained copper bus bar, which was undeclared, 5.0 tons of networking cable as against declared 2.3 tons; 4-wheel ATV beach buggy bikes (19 pieces), which were declared and endorsed by examiner as 49cc instead of actual 99cc; a micro computer photo electric error controller (undeclared) and 6.0 tons weight of motor cycle chain sprocket, which was reported as 1.2 weight of tons.

The subject consignment was seized and as per the directives of DG I&I Lutfullah Virk, FIR was lodged booking Syed Khurram Ahmed of M/s Anum Traders, Muhammad Intizar of M/s Hasnain Sons clearing agent and Amir Shuja examiner at MCC Port Qasim.

Stubborn KICT continues with the habit of evading duty and taxes

KARACHI: The Directorate of Post Clearance Audit – Customs has detected evasion of duty and taxes to the tune of Rs7.733 million by M/s Karachi International Container Terminal (KICT) through mis-declaration of classification.

Scrutiny of import data revealed that M/s Karachi International Container Terminal Limited imported a consignment of Self Propelled Telescope Boom Model No. : S- Booms. S-105, quantity 01 set, cleared from MCC Appraisement – West by mis-declaring the goods under PCT 8426.4100 attracting zero customs duty whereas the said goods are correctly classifiable under PCT heading 8709.1900 chargeable to custom duty of 30 percent.

Thus M/s KICT by misdeclaration of classification evaded duty and taxes totaling Rs7.733 million. PCA has advised M/s KICT to pay the evaded amount of duty and taxes in the national exchequer.

It may be mentioned here that M/s KICT seems to be a habitual culprit. In February 2015, PCA prepared a contravention report against M/s KICT for evading duty and taxes worth Rs50.401 million through claiming inadmissible benefit of SRO 659(I)/2007 pertaining to the import of cable, transformers, cable reel, control box etc.

Moreover, another contravention report was prepared in February 2015 against M/s KICT for evading duty and taxes worth Rs85.188 million through claiming inadmissible benefit of concessionary SRO 659(I)/2007 and SRO 575(I)/2006 by mis-declaring the classification of imported goods including hybrid control system for rubber type gantry cranes, electric house and generating sets, air-condition hybrid system etc.

Another contravention report was prepared in March 2015 against M/s KICT for evading duty and taxes worth Rs238.015 million through claiming inadmissible benefit of concessionary SRO 575(I)/2006 by pertaining to the import of used quay cranes with spreader, standard accessories etc.

M/s KICT since the beginning of year 2015 has so far evaded a sum of Rs381.337 million depriving national exchequer of its legitimate revenue.

Post Clearance Audit committed to plug revenue leakage

KARACHI: The Directorate of Post Clearance Audit (PCA) has made 29 contravention reports and audit observed in the month of August 2015 involving revenue of Rs153.028 million.
This revenue leakage has been identified during scrutiny of data and pertains to inadmissible benefit of concessionary SRO 575(I)/2006; concessionary SRO 1125(I)/2011, SRO 565(I)/2006, SRO 450(I)/2001.
PCA has also identified short-payment of customs duty, sales tax and income tax pertaining to various imports.
Moreover, the Directorate of Post Clearance Audit has also detected evasion of customs duty, sales tax and income tax due to mis-declaration of classification on import of various goods.
It has also been found that evasion of leviable customs duty, sales tax and withholding income tax by clearance of goods at lesser weight/quantity than the declared weight/quantity.
An official said that the campaign of Director PCA Gul Rehman has been quite effective as the audit observations and contravention reports have discouraged under-invoicing, mis-declaration and misuse of concessionary SROs.
Gul Rehman has formed a special team headed by Deputy Director Adnan Rafique. This team would keep check and monitoring on the clearance of items that were earlier found to be under-invoiced or mis-declaration.
Official said that their campaign had also discouraged nexus between importers/customs agents and the Customs officials.


FTO empowers regional offices to investigate complaints

KARACHI: The Federal Tax Ombudsman Secretariat has empowered the Advisors posted at Ombudsman’s regional offices across the country to investigate the complaints pertaining to income tax, Customs, sales tax, federal excise duty and Freedom of Information Ordinance, 2002,

The measure has been taken for the convenience of taxpayers across the country and also for appropriate capacity utilization.

The FTO head office in Islamabad would investigate the complaints pertaining to MCC Islamabad and Gilgit-Baltistan along with Regional Tax Offices of Islamabad, Rawalpindi and Gilgit Baltistan.

Similarly FTO Regional office Abbotabad would address the complaints pertaining to RTO Abbotabad and Hazara Division from MCC Peshawar.

FTO Regional office Quetta would deal with issues pertaining to RTO Quetta and entire Balochistan alng with MCC Quetta and Gwadar.

FTO’s Karachi office would address the complaints related to RTO Karachi and Hyderabad as MCC Appraisement (West & East), MCC Exports (Port Qasim & Custom House Karachi), MCC Preventive and MCC Port Qasim.

FTO Office Sukkur would deal with issues relating to RTO Sukkur and MCC Hyderabad; FTO Lahore office would take care of complaints relating to RTO Lahore, Sargodha and Gujranwala and MCC Lahore, Multan and Faisalabad; FTO office in Sialkot would investigate complaints regarding RTO Sialkot and MCC Sambrial Sialkot.

Anti Smuggling Organization foils bid to smuggle diesel

KARACHI:The staff of Anti Smuggling Organization (ASO) of Model Customs Collectorate (MCC) Hyderabad foiled a bid to smuggle 25,000 litres High Speed Diesel (HSD) from Quetta to interior Sindh. The commodity and the tanker were also impounded.

According to a FIR, Additional Collector Omar Shafiq was tipped that diesel would be smuggled from Quetta in a vehicle without registration number plate.

Subsequently, the ASO staff spotted a truck parked at a hotel near Toll Plaza, Jamshoro. Upon enquiry from the hotel staff and thereafter no cleaner, driver of any other person came forward to claim the ownership of the parked/ abandoned vehicle.

The ASO staff during examination of the truck found that a tank concealed and mounted in the 12-wheeler truck, surrounded by steel walls and backed with wooden covers. The registration plate was not found. The cabin of the truck was searched for recovering documents as to the registration of the vehicle or calibration chart and invoices about HSD loaded in the impounded vehicle.

After completion of legal formalities regarding seizure at the plat of occurrence, ASO staff brought the seized vehicle to MCC Hyderabad and lodged an FIR.

The value of the confiscated HSD is estimated to be approx Rs1.8 million and of impounded vehicle estimated to be Rs3.0 million while the amount of duty and taxes involved are estimated to be around Rs0.809 million.

Sugar miller, PRAL staff booked in export subsidy scam

KARACHI: The MCC Peshawar has booked sugar miller, customs agent and PRAL staff in the export subsidy fraud as the gang evaded duty/taxes and attempted to fraudulently avail huge amount of export subsidy in respect of fake exports of sugar to Afghanistan.

FIR has been registered against Choudhry Sugar Mills, M/s Ibrab Customs Clearing and M/s Pakistan Revenue Automation Limited (PRAL) in respect of fake export of 500 MT of Sugar from Torkham border to Afghanistan during April 2015-August 2015.

The custom value of the case was evaluated to be $225000 with duty and taxes involved estimated to be Rs1.836 million.

The FIR was lodged by Inspector Yaqoob Shah of Customs PS Torkham who stated that Assistant Collector Custom Station Torkham on receipt of information about export subsidy fraud case, constituted an audit team on August 18, 2015. The audit team retrieved data from PRAL pertaining to the export of Sugar for the period 01-04-2015 to 12-08-2015 for cross verification of the exports with manual record maintained by the Customs staff at Torkham.

The team upon scrutiny found that Goods Declaration (GDs) were available in the manual record but found tampered with in the system.

It was noted in the FIR that the exporter got the data tampered in PRAL system with the connivance of PRAL staff.

The act of the exporter and clearing agent amounts to fiscal fraud as the accused have not made the actual export whereby besides depriving the state of foreign exchange worth  $225000 have also caused loss to the revenues of the state in terms of EDS ( Export Development Surcharge)  withholding tax and sales tax.

The exporter also evaded Federal Excise Duty to the tune of Rs1.836 million , the FIR said.

The fraud aimed at availing huge amount of subsidy of inland freight of Rs2.0 per Kilogram and cash subsidy on export of Sugar at the rate of Rs8.0 per kilogram allowed on export of Sugar as per decision by Economic Coordination  Committee of the Cabinet (ECC), the FIR said.

Custom sources are terming the registration of first ever FIR in fake Sugar export case to be tip of an iceberg and maintained that stage is now set for unearthing subsidy fraud cases worth billions of rupees involving sugar millers from Punjab and Khyber Pukhtoonkhawa.

Importer seeks SHC permission for release of goods against bank guarantee

KARACHI: A division bench of High Court of Sindh issued notice to the FBR, Collector Customs, West and Director General, Directorate of Valuation for Sept 11 , in an application filed by Perwaiz Trading Corporation seeking release of imported consignments against a bank guarantee instead of cash payment of pay order equivalent to the differential value of duty and taxes etc.

High Court of Sindh earlier on  Sept 04 has allowed an application by the petitioner for release of consignments if it deposits the diferential/ disputed amount against customs duty, tax and other levies .

The application was moved by the petitioner company in a petition CP-D 5239/ 2015 making the Chairman, Federal Board of Revenue (FBR), Collector Customs, West ,Model Custom Collectorate, Director General and Director Valuation respondents in the petition.

 The maintained that his company is a regular importer of AC Disk, Fog Type 80 KN Porcelain Insulators from China ( Dalian Insulators Grouo. The item was normally importedby National Transmission and Dispatch Company (NTDC) WAPDA , DISCO, K Electric all power utility companies.

The petitioner maintained that custom authorities were approached for assessment as per GD (Goods Declaration) at a rate of US $ 9.6039 per Kilogram under HS Code 8546-2000 but respondent Director Valuation  tried to impose value under Valuation Regulation 729/2015. The petitioner alleged that over valuation was managed by / or at thew behest of EMCO Industries Lahore who are the sole manufacturer of the identical goods. The petitioner maintains that they have filed the Review application which is still pending. The petitioner however moved the court as more consignments landed at the port and increasing demand by clients necessitated immediate clearance/ release of the consignments.

The bench on previous hearing allowed the request for release of goods but on condition that petitioner will pay the differential amount in respect of disputed custom duty, taxes etc . The money was to be deposited with the Nazir of Sindh High Court. Today, the bench heard an application by the petitioner who sought an amendment to the earlier order where by instead of cash payment or pay order, the release of goods was sought against a bank guarantee.

Gold smuggler arrested

KARACHI: The MCC Preventive has arrested a person for attempting to smuggle gold slabs into the country and seized the commodity worth Rs2.64 million. An FIR to this effect has been lodged and investigations are underway.

On the directives of Collector Preventive Tariq Huda, Additional Collector AFU Tahir Qureshi and Assistant Collector Wasif Malik have initiated a campaign against the gold smuggling into the country and smuggling of currency out of the country in particular.

According to the details of the case, credible information was received by SPS Tahir Rashid to the effect that an attempt of smuggling of gold would be made by a passenger namely Syed Asif Abbas Zaidi travelling by Shaheen Airline’s Flight No. NL-737 from Dubai to Karachi.

Strict surveillance was maintained on the passengers of the said flight and later the above named passenger was intercepted after having been cleared from Immigration Counter who travelled with-out baggage except a hand Trolley bag.

He was brought to customs examination area where he was asked to declare whether he was carrying any contraband goods in his bag or on his person. On his refusal, hand Trolley bag was thoroughly searched but nothing objectionable was recovered.

Since specific information existed, he was afforded an opportunity of being searched before a Magistrate or Gazetted Officer but he did not opt for that. Therefore, his personal search was conducted in the presence of two witnesses and recovered six slabs of gold (three slabs each wrapped, in white paper pasted with adhesive scotch under each foot) weighing ten tolas each, total 60 tolas.

The goods so recovered were seized along-with a pair of shoes as containers and traveling documents of the passenger.

Customs values of ceramic & porcelain tiles revised

KARACHI: The Directorate General of Customs Valuation has fixed the Customs values of ceramic & porcelain tiles vide Valuation ruling No.758/2015.

This is a very important ruling and Additional Director Iqbal Muneeb and Assistant Collector Dr. Shahzad, on the directives of Director Manzoor Memon, conducted thorough research and survey for this purpose.

Customs values of Ceramic and Porcelain Tiles were determined vide Valuation Ruling No.538/2013. Importers of Tiles have repeatedly agitated against the higher determination of values and requested for revision of values on the ground that the existing Valuation Ruling is more than two years old and price in international market especially China and Iran have gone down considerably.

Recently certain importers have filed petitions in the Sind High court against the existing valuation ruling mainly on the grounds that the existing ruling is very old and needs revision and cannot be applied on the current imports.

Sind High court vide interim order dated September 01, 2015 has directed that goods of the petitioners shall be released subject to deposit of differential of 20 percent of the Customs Duty and taxes with the Nazir of the court and payment of the balance to the Customs.

Keeping in view the aforesaid position, an exercise to re-determine the Customs values of Ceramic and Porcelain Tiles was initiated.

PCA serves contravention report against Lyallpur Chemicals and Fertilizers

KARACHI: The Directorate of Post Clearance Audit (PCA) has prepared a contravention report against M/s Lyallpur Chemicals and Fertilizers Limited for evading leviable taxes through claiming inadmissible  benefit of concessionary SRO No.551(I)/2008.

According to the details of the case, scrutiny and audit of import data found that M/s Lyallpur Chemicals and Fertilizers Limited imported a consignment vide under PCT heading 2510.1000 through MCC Appraisement (West) said to contain “Natural Rock Phosphate 30% Un-Ground” and got the consignment cleared on payment of 1.0 percent Income Tax, by claiming SRO 551(I)/2008.

The claimed SRO for Sales Tax exemption is not covered under zero rating regime of Sales Tax for payment of Income Tax at the rate of 1.0 percent. The importers were required to pay Income Tax at the rate of 3.0 percent and anti-dumping duty.

Thus an amount of Rs3.235 million has been short paid/evaded by the importers on account of withholding Income Tax and Antidumping Duty.

Accordingly, an Audit Observation was issued to M/s Lyallpur Chemicals and Fertilizers Limited, but the importer failed to clarify their position regarding short payment of Income Tax. In view of the aforesaid M/s Lyallpur Chemicals and Fertilizers Limited are held to have intentionally & willfully caused loss to the Government exchequer.

Contravention report is forwarded herewith for initiation of adjudication proceedings in the case.

FBR discontinues performance allowance of BS-16 officials

KARACHI: The Federal Board of Revenue (FBR) has discontinued ‘performance allowance’ of hundreds of Customs and Inland Revenue officers of BS-16 as these officials had not submitted the Declaration of Assets, which is required as per Guidelines for Performance Allowance 2015.

As many as 806 officials of Customs Department belonging to various cadres were drawing performance allowance, which has been discontinued for three months or filing of their Declaration of Assets.

Similarly, performance allowance of 474 officials of Inland Revenue Department of various cadres has also been discontinued.

These officers were drawing performance allowance, which equals 100 percent of basic salary.

FBR advises enforcement of austerity measures

KARACHI: The Federal Board of Revenue (FBR) has forwarded the directives of Finance Division to enforce certain austerity and economic measures during the financial year 2015-16.

Accordingly, there will be complete ban on purchase of all types of vehicles both for current as well as development expenditure except operational vehicles of law enforcing agencies for which NOC from Finance Division would be required.

Creation of new posts will be banned except those required for development projects and approved by competent authority.

Entitlement of periodical, magazines etc of all officers will remain restricted to only one daily newspaper.

Serving of official lunches and dinners would be restricted while principal accounting officers will ensure rationalization of utility bills while remaining within the available budget as no re-appropriation will be authorized to/from utilities.
