SHC frames legal issues in identical suits as to powers for ST recovery

KARACHI: Justice Muhammad Junaid Ghaffar of High Court of Sindh (SHC) on Monday fixed Feb 29 to hear about half a dozen identical suits on common point of law pertaining to the powers of Custom Authorities for collecting Sales Tax, conducting raids and taking into custody record relevant to the alleged tax evasion.

The bench earlier heard a suit filed by A.Z Agro Industries limited against a raid and impugned notice for recovery of rupees 51.165 million as Sales Tax.

Masooda Siraj advocate, counsel for official respondents at the outset drawn the attention of the court to suits in identical nature bearing numbers 2212, 2113,2019 and 1616 of 2015 and said common law points are involved in these suits.

She told the court that suits are liable to be disposed of as no law was violated and in fact plaintiff have evaded sales tax by selling their goods to non registered companies just to evade tax amounting to billions of rupees.

It was prayed that all suits be heard at one time so that a common judgment is passed avoiding legal complications. The bench agreeing to the proposition fixed next hearing on Feb 29 (current year is a leap year).
